Wright v. State, No. 02-19-00395-CR (Feb. 4, 2021) (Birdwell, J., joined by Womack and Wallach, JJ.).
Held: The State was not required to establish a reliability predicate under Kelly v. State, 824 S.W.2d 568 (Tex. Crim. App. 1992), before it could introduce testimony that an officer used the software Cellebrite to extract data from a cellphone, and thus the State’s potential failure to establish such a predicate through expert testimony was immaterial.
