Cole v. Wolfram, No. 02-21-00410-CV (Apr. 28, 2022) (Sudderth, C.J., joined by Birdwell and Walker, JJ.).

Held:  Appellee’s motion for security for costs is not a “legal action” within the meaning of the Texas Citizens Participation Act (TCPA).  See Tex. Civ. Prac. & Rem. Code Ann. § 27.001(6).  Accordingly, the trial court properly denied Appellant’s TCPA motion to dismiss Appellee’s motion.
