Phillips v. State, No. 02-21-00116-CR (July 28, 2022) (Wallach, J., joined by Kerr and Womack, JJ.).
Held: The State’s jury argument was a response to Appellant’s defense and evidence and was not an improper comment on Appellant’s right to a jury trial. Further, the trial court did not reversibly err by admitting video evidence impeaching Appellant’s defense witness, and the record does not show that Appellant’s trial counsel provided ineffective assistance.
