McDaniel v. Crowley Independent School District, No. 02-24-00053-CV (Mar. 20, 2025) (Wallach, J., joined by Sudderth, C.J., and Bassel, J.).

Held: Alice McDaniel, as executor of the estate of a former Crowley I.S.D. employee, sued Crowley I.S.D. and Omni Financial Group, Inc., to recover death benefits under an employee deferred compensation plan. McDaniel sued for breach of contract, breach of fiduciary duty, and other claims. During the course of the proceedings, the death benefits were paid without objection to the beneficiaries who had been designated by the decedent. That payment mooted McDaniel’s breach-of-contract claim, and her remaining claims are barred by governmental immunity.
